TERMS OF SERVICE & REFUND POLICY: ETERNALLY OPEN-ARTED - TIFFANY GOW ART

EFFECTIVE FROM AND LAST UPDATED 21ST JULY, 2026

1. THE SIGNATURE ACQUISITION STANDARD: FINALITY OF SALE

At Eternally Open-Arted, we view the acquisition of fine art as a permanent commitment between the collector and the work. Every original canvas and bespoke print by CEO AND Artist: Tiffany Gow, is a singular, hand-crafted creation. Because each piece is prepared specifically for its new home through our PROFESSIONAL GALLERY-STANDARD PACKAGING and stewardship process, we do not facilitate refunds, returns, or exchanges.

By completing your purchase and ticking the "Accept Terms and Conditions / Terms of Service" box at checkout, you acknowledge that all sales are final. No refunds and no exchanges are permitted under any circumstances, and the work is being permanently retired from the studio collection into your care.

2. BINDING AGREEMENT & GOVERNING LAW

By accessing this website, purchasing original fine art, and ticking the "Accept Terms and Conditions" box at checkout, you acknowledge that you have read, understood, and entered into a legally binding contract. This agreement is governed by the laws of Australia. By completing your purchase, you agree to all legal information included in these specific Terms and Conditions.

3. WHAT IS INCLUDED IN YOUR PURCHASE: SHIPPING, INSURANCE & TAXES

PLEASE READ CAREFULLY: THE FOLLOWING TERMS GOVERN THE DELIVERY AND EXTERNAL COSTS OF YOUR INVESTMENT. BY PROCEEDING WITH A PURCHASE, YOU ACKNOWLEDGE AND ACCEPT THESE CONDITIONS WITHOUT EXCEPTION.

  • INTERNATIONAL DUTIES & TAXES – THE BUYER IS SOLELY RESPONSIBLE FOR ALL IMPORT DUTIES, CUSTOMS FEES, AND LOCAL TAXES (VAT/GST) IMPOSED BY THEIR DESTINATION COUNTRY. THESE CHARGES ARE NOT INCLUDED IN THE PURCHASE PRICE OR THE SHIPPING COST. ETERNALLY OPEN-ARTED AND TIFFANY GOW ARE NOT LIABLE FOR ANY DELAYS, SEIZURES, OR ADDITIONAL COSTS IMPOSED BY INTERNATIONAL CUSTOMS DEPARTMENTS.

  • HARDWARE EXCLUSION – ORIGINAL ARTWORK FROM ETRENALLY OPEN-ARTED AND TIFFANY GOW DOES NOT INCLUDE HOOKS, BRACKETS, OR HANGING MECHANISMS. THE PURCHASE PRICE COVERS THE PHYSICAL ARTWORK ONLY. THE BUYER IS SOLELY RESPONSIBLE FOR ACQUIRING, FINANCING, AND INSTALLING ALL NECESSARY HANGING HARDWARE.

  • PREMIUM PROFESSIONAL GALLERY-STANDARD PACKAGING – WE PRIORITISE THE SAFETY OF YOUR ARTWORK BY UTILISING HEAVY-DUTY CUSTOM CRATING, ACID-FREE WRAPPING, AND IMPACT-RESISTANT CUSHIONING TO PROTECT THE STRUCTURAL INTEGRITY OF THE LARGE-SCALE CANVASES.

  • HIGH-VALUE TRANSIT INSURANCE – EVERY PIECE IS FULLY INSURED FOR ITS TOTAL COMMERCIAL VALUE FROM THE MOMENT IT LEAVES OUR STUDIO UNTIL IT IS DELIVERED.

  • CHOSEN PROFESSIONAL COURIER – WE UTILISE A SPECIALLY SELECTED ART-HANDLING COURIER (OUR CURRENT CHOSEN PROVIDER IS PACK & SEND) TO ENSURE "GOLD SERVICE" TREATMENT AND PROFESSIONAL HANDLING DURING THE ENTIRE TRANSIT PROCESS.

4. MANDATORY ACKNOWLEDGEMENT: ARTISTIC INTEGRITY & INTENTIONAL TEXTURE

By proceeding with a purchase, the collector explicitly accepts and agrees that hand-applied archival seals, sculptural textures, and studio-directed finishing processes are fundamental, non-negotiable elements of the studio’s bespoke process for all works, including original canvases and fine art prints. These characteristics are binding conditions of the sale and are not subject to refund and are not subject to exchange:

  • 'Crimson Soul - Tears of the Luminous Heart': The intentional "Tear Drop" raised gloss features and visceral, intentional high-relief textures. This work features an intentionally specifically created and curated coarse and abrasive texture which is a deliberate action and thought of the artist, designed to enhance the physical presence and sculptural narrative of the work. This dimensional structural relief features raised elements and defined textural edges that are present across the entirety of the piece. This includes the face of the canvas, the corners, the edges, the vertical and horizontal borders, the fold-over points, the frame surrounds, and the structural chassis. It is recommended that precautionary safety and awareness is essential whilst handling this original canvas.

  • 'Psychedelic Synergy'": The complex, multi-layered fluid interactions and the intentional presence of aerated micro-drops within the archival seal. These deliberate textural elements are a byproduct of the manual, atmospheric distribution of the finish, specifically curated to capture the electric and vibrant expansion of the work's energy.

  • The Entire Collection: Every work created by Tiffany Gow is defined by its unique, hand-directed surface. This includes any and all fine-point textural variations, dimensional elements, or surface-level characteristics across the entirety of the portfolio. This encompasses the entirety of the canvas, from the central composition to the edges, sides, corners, and structural chassis. Every nuance of the manual finishing process is an intentional part of the work’s evolution and provenance.

  • Authentic Fingerprints: Any and all variations across the entire three-dimensional surface are the authentic fingerprints of a unique, hand-crafted investment and are not considered defects. The way each archival layer settles is a deliberate part of the work’s final evolution, ensuring that the surface reflects the raw, studio-born energy of its creation. As these elements are verified expressions of artistic intent across all visible and structural surfaces, they are not subject to return or refund.

5. SAFE HANDLING & EXCLUSION OF LIABILITY

Due to the highly tactile, textural, and sculptural nature of Tiffany Gow Art, all works must be handled with the level of care afforded to a professional gallery investment.

  • Intentional Physicality: The collector acknowledges that the artwork is a three-dimensional object featuring intentionally specifically created and curated coarse textures and raised structural elements.

  • Assumption of Risk: By completing the acquisition, the collector assumes all responsibility for the safe handling, unboxing, and installation of the work.

  • Exclusion of Liability: Eternally Open-Arted and Tiffany Gow are not liable and are not responsible for any injury, medical situation, or health-related incident arising from the physical handling, contact with, or mounting of the artwork. Once the work is in the collector’s possession, Eternally Open-Arted and Tiffany Gow are absolved of all responsibility regarding physical interaction with the piece.

  • Stewardship of Display: It is the collector's duty to ensure the work is displayed in a manner that is safe for the environment and all individuals interacting with the space.

6. INSTALLATION, DISPLAY & ENVIRONMENT

Eternally Open-Arted and Tiffany Gow are not liable for any damage, injury, or degradation of the work resulting from improper stewardship or installation after delivery.

  • Professional Installation Requirement: We highly recommend that the buyer acquires a professionally trained and experienced art installer to hang the piece. The buyer is solely responsible for finding and financially compensating a qualified professional.

  • Installation Liability: Eternally Open-Arted cannot be held responsible for the work falling or sustaining damage due to improper mounting, faulty hardware, or wall failure. Since no hanging mechanisms are supplied with the artwork, the choice and security of the installation method rest entirely with the buyer and their chosen installer.

  • Environmental Damage: We are not liable for damage caused by exposure to direct sunlight, high humidity, extreme temperature fluctuations, or the use of cleaning chemicals or abrasive materials to the archival surface.

7. RISK TRANSFER & TRANSIT STEWARDSHIP

  • Transfer of Risk: Risk of loss and title for the artwork pass to the buyer the moment the item is collected by the carrier from our studio.

  • Courier Liability: While we use premium couriers, Eternally Open-Arted is not responsible for damages or delays caused by the carrier. In the event of transit issues, we will assist you in filing a claim through the provided high-value insurance.

  • Transit Damage Protocol: In the rare event of transit damage, we provide professional support provided the following protocol is met:

    1. 24-Hour Notification: Please contact the studio within 24 hours of receipt.

    2. Documentation: Provide clear photographs of the external packaging (prior to opening) and the internal damage.

    3. Stewardship: Following this 24-hour window, the physical and financial stewardship of the work transfers entirely to the collector.

  • Address Liability: The buyer is 100% responsible for providing an accurate delivery address. No refunds are issued for loss due to address errors.

8. INTELLECTUAL PROPERTY & BRAND PRESERVATION:

All artworks, slogans, business names, logos, designs, text, and digital images are the exclusive intellectual property of Tiffany Gow and Eternally Open-Arted.

  • Formal Registration: The business name Eternally Open-Arted is formally registered with IP Australia.

  • Exclusive Slogan: The slogan Eternally Exclusive Essence™ is the exclusive property of Tiffany Gow and Eternally Open-Arted.

  • Copyright & Trademark: These assets are protected under Australian and International Copyright and Trademark laws. Eternally Open-Arted asserts its formal ownership and creative authority over its entire brand identity and portfolio.

  • Prohibition of Use: Any unauthorised use, reproduction, scanning, derivative creation, or commercial distribution of this content is strictly prohibited.

9. FINAL SALE POLICY

Due to the unique, bespoke, and one-of-a-kind nature of fine art, all sales are final. By completing the checkout process, you acknowledge that all sales are final. No refunds, No Returns and No Exchanges are permitted under any circumstances, and you waive any right to a refund, return or exchange, based on the intentional physical and textural characteristics described in Section 4.

10. EVENTS BEYOND CONTROL - FORCE MAJEURE

Eternally Open-Arted shall not be held liable for any failure or delay in performing its shipping or delivery obligations if such failure or delay is caused by events beyond our reasonable control, including but not limited to: natural disasters, pandemics, government restrictions, customs strikes, global shipping disruptions, or telecommunications failure.
